TERMS OF USE

These Terms of Use are our copyright which is protected by intellectual property. If its use by any third party, including excerpts from these Terms of Use for commercial purposes related to the offer of goods and/or services, is not permitted. Any violation may be conducted as subject to legal action.

DEFINITION

  1. Account” means the TRANS FASHION INDONESIA Account that you will need to register on our platform. Once it is registered, you will be able to submit an order.
  2. Business Day” means a day from 9.00-18.00 in Indonesia time, excluding Saturdays, Sundays, and national holidays.
  3. Customer” means you as individual who places an Order on the Platform;
  4. Order” means the Order submitted by you to the Platform to purchase a Product from us.
  5. Platform” means collectively information published in TRANS FASHION INDONESIA website, and any other websites or applications which we may own or operate from time to time, each of which shall be described as a “Platform”.
  6. Product” means any product available for sale to on the Platform;
  7. Website” means the TRANS FASHION INDONESIA website accessed at the following address at transfashion.id.
  8. You” means as a customer or a guest on the platform.
  9. Headings are for ease of reference only and shall not affect the interpretation or construction of the Terms Of Use;
  10. Words imparting the singular shall include the plural and vice versa. Words imparting a gender shall include every gender and references to persons shall include an individual, company, corporation, firm or partnership; and
  11. References to “Includes” or “Including” or like words or expressions shall mean without limitation.

ELIGIBILITY

To have an account of TRANS FASHION INDONESIA, you must be over eighteen (+18) years of age. If you are under eighteen (18), you may place an Order with TRANS FASHION INDONESIA only with the involvement of a parent or guardian.

PROHIBITIONS

  1. You must not misuse our Platform. You shall not use any automated systems or software to extract data from this Platform for any purpose. You shall not commit or encourage a criminal offence, transmit or distribute a virus including but not limited to Trojan horse, worm, logic bomb or post any other material on the Platform which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into; corrupt data; cause annoyance to other users; infringe upon the rights of any other person’s proprietary rights; send any unsolicited advertising or promotional material; or attempt to affect the performance or functionality of any computer facilities of or accessed throughout the Platform.
  2. Any violation of this provision is a criminal offense under the Act Number 11 year 2008 about Internet and Electronic Transaction, Act Number 19 year 2016 about the revision of Act Number 11 year 2008 about Internet and Electronic Transaction, also law and other as well as other relevant laws and regulations.

ENTIRE AGREEMENT

  1. These Terms Of Use shall apply to your use of the Platform and all Orders made or to be made by us for the sale and supply of Products. These Terms Of Use constitute the entire agreement between you and TRANS FASHION INDONESIA and supersede any and all preceding and contemporaneous agreements.
  2. You acknowledge that by entering into this Terms, neither you nor TRANS FASHION INDONESIA have relied on any representation, undertaking or promise given by the other or implied from anything said or written between you and us prior to such Terms Of Use, except as expressly stated in the Terms Of Use.

TERMS OF PURCHASE

  1. Registration

To place an Order, you must register with us by creating an Account on the Platform. You must only submit to us information which is accurate and true. You must also keep your information up to date by informing us of any changes, by using the relevant sections of the Platform. You shall not misuse the Platform by creating multiple user accounts.

  1. Formation Of An Order

(a) The information set out in the Terms Of Use and the details contained on this Platform do not constitute an offer for sale but rather an invitation to treat. No Contract in respect of any Products shall exist between you and us until we have shipped the Products to your address.
(b) To submit an Order, you will be required to follow the online shopping process on the Platform. After this you will receive an Order Acknowledgment which will act as an acknowledgement of our receipt of your Order. You acknowledge that the receipt of an Order Acknowledgment is not considered an acceptance of your Order by us.
(c) An Order is only considered accepted by us upon your Order being shipped to the delivery address provided by you, at which time you will receive an email notifying you that the Order has been shipped. Please check on the order status via the Platform.

  1. Price And Payment

TRANS FASHION INDONESIA makes best effort to ensure all details, descriptions and prices appearing on this Platform are accurate, however there are circumstances where errors may occur. If we discover an error in the price of a Product that you have ordered, we will inform you of this as soon as possible and you may choose to reconfirm your Order at the correct price or cancel your Order. If we are unable to contact you, we will cancel your Order. If you cancel before the Order is shipped and you have made payment, you will receive a full refund.
(a) Prices listed are inclusive of tax and are in Indonesian Rupiah (Rp). Shipping charges will be charged as an additional fee if applicable; the surcharge is clearly displayed and included in the ‘Final Amount’.
(b) We are under no obligation to fulfill your Order if the price listed on this Platform is incorrect (even after your Order has been acknowledged by us).
(c) You can make payments using one of our payment partners registered on our Platform or make cash on delivery or cash on delivery. You may also pay all or part of the price of your Order using an e-gift card, wallet credit or promotional voucher.
(d) E-gift cards and promotional vouchers can only be entered at the online check-out page. Physical presentation of vouchers to TRANS FASHION INDONESIA employees is not acceptable.
(e) To minimize the risk of unauthorized access, we will encrypt your card data. Once we receive your Order we will request a pre-authorization on your card to ensure funds are available to complete the transaction. Orders will only be confirmed once this pre-authorization check is complete. Your card will be debited after we have sent the Order Confirmation. Validation and validation checks on the card will be carried out by the card issuer. If we do not receive the required authorization, we are not responsible for any delay or non-delivery.
(f) Upon authorization of payment, clicking the “Order Now” button means that you confirm that the card belongs to you or that you are the legal holder of the e-gift card or promotional voucher and have sufficient funds to pay the Product fee.

  1. Mistaken Orders

If you discover that you have made a mistake with your Order after you have submitted it to the Platform, please contact info@transfashionindonesia.com. TRANS FASHION INDONESIA will try our best to process your request.

  1. Refusal Of Orders

(a) We reserve the right to withdraw any Products from this Platform at any time and/or remove or edit any materials or content on this Platform. We will make our best efforts to always process all Orders but there may be exceptional circumstances wherein we may need to refuse to process an Order after we have sent you an Order Acknowledgement, which we reserve the right to do at any time at our sole discretion.
(b) If we cancel your Order and you have already made payment for your Order, the payment amounts will be fully refunded to you.
(c) We will not be liable to you or any other third party by reason of our withdrawing any Product from this Platform, whether it has been sold or not, removing or editing any materials or contents on this Platform or for refusing to process or accept an Order.

DELIVERY

  1. Address By Orders

We aim to deliver the Product to you at the place of delivery requested by you in your Order and the delivery date and time indicated by us at the time of your order checkout (as updated in the Order Acknowledgement).

  1. Update Notification

We will attempt to notify you if we expect to be unable to meet our estimated delivery date, but, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.

  1. Signing Delivery

Upon delivery of the Product, you may be required to sign for home delivery. You may chat t0 TRANS FASHION INDONESIA WhatsApp, and provide the documents delivered with the Product, upon request. If you have not received your Order but the order status is showing as ‘delivered’, please contact TRANS FASHION INDONESIA WhatsApp, and Customer Service Team will advise you directly.

  1. Limited Delivery Range

Please note that it might not be possible for us to deliver to some locations, in which event we will inform you using the contact details that you provided to us when you made your Order and arrange for cancellation of the Order or delivery to an alternative delivery address.

  1. Delivery Based Packaging Standard

All risk in the Product shall pass to you upon delivery, except that, where delivery is delayed due to a breach of your obligations, risk shall pass at the date when delivery would have occurred but for your breach. From the time when risk passes to you, we will not be liable for loss or destruction of the Product. Any breach of obligations by you might impact your ability to shop on TRANS FASHION INDONESIA in the future.

  1. Contacts

If you are not available to take delivery or collection, we will attempt to contact you. A re-delivery will be attempted the next working day. You may also contact our Customer Service Team or the courier for more information. If delivery or collection is delayed through your unreasonable refusal to accept delivery or if you do not (within one week of our first attempt to deliver the Product to you) accept delivery or collect the Product from the carrier, we may (without affecting any other right or remedy available to us) do either or both of the following:

(a) Charge you for any fee and other costs reasonably incurred by us; or

(b) No longer make the Product available for delivery or collection and notify you that we are immediately canceling the applicable purchase, in which case we will refund to you or your credit or debit card company as applicable any money already paid to us under the Contract, less our reasonable administration charges (including for attempting to deliver and then returning the Product).

  1. Others

(a) You acknowledge that the Products are standard and not made bespoke to fit any particular requirements that you may have. 

(b) In event there exists a conflict of total cart size for free shipping entitlement, the value on our Platform shall prevail.

(c) TRANS FASHION INDONESIA provides free shipping on all orders above the threshold set out in the Shipping Fees Policy.

CANCELLATION BY CUSTOMER (NON-FAULTY PRODUCT)

  1. If you wish to cancel your Order, you may cancel via the Platform. Cancellation is only available for Orders that are not packed. You may reach out to our Customer Service Team via WhatsApp Official, or an email at this info@transfashionindonesia.com, and our Customer Service Team will advise you accordingly. 
  2. No cancellation fees shall be applicable. Once an Order has been packed it may not be canceled and the item must instead be returned to the company according to our Return Policy, or as otherwise advised by the Customer Service Team. Any payment made will be refunded. Please refer to our Cancellation Policy for more information.

RETURNS AND REFUNDS POLICY

  1. Within 30 Days Of Receipt

If you are not completely satisfied with your purchase, you may return the Product to us within thirty (30) days of receipt, in accordance with our Exchange or Refund/Exchange Policy. The Product shall be unused, Product tags shall not be tampered with, and the Product shall be in the original brand packaging (if applicable). This policy is applicable only to those products which do not fall under the list of non-refundable brands/items provided on our Platform.

 

  1. Received in Similar Condition

All items must be received by TRANS FASHION INDONESIA in order for a customer to be eligible for a refund or replacement. You shall ensure that the Product is sent to us in the same condition as it was when received by you and is packaged properly. In the event that an item is returned to us in an unsuitable condition, we reserve the right not to accept returns and send the Product back to you. Appropriate measures, including legal action, may be taken in the event we discover a misuse of TRANS FASHION INDONESIA Exchange.

 

  1. Do Not Honour Any Walk-In Returns

Your returned Products together with your return slip are usually received and accepted at our warehouse within five (5) working days after drop off. Returns handling time will vary depending on your return method and courier of choice. Our Quality Check team will take up to two (2) working days to process your return.

 

  1. Refund for Returns

Refunds for returns will be issued shortly after we receive and check your items, according to the preferred refund method indicated on your return slip. In cases of purchase exchanges, we will refund you via wallet credit which you may utilize for your next purchase. In the event you prefer to be refunded by different means, please contact our Customer Service Team via chat here or drop us an email at info@transfashionindonesia.com, and we will try our best to assist you accordingly. FAULTY PRODUCTS

  1. All Product descriptions, information and materials posted on this Platform are provided ‘as is’ and without warranties express, implied or otherwise, and however arising.
  2. Product image as seen on the Platform may slightly different from the actual Product after you received it.
  3. If the item you receive is faulty, please contact our Customer Service Team and provide your Order number, your name and address, details of the Product and the reason for return, and whether you require a refund or a replacement. Please refer here for more details.
  4. Upon receipt of the Products, we will examine it and we will advise you on the status of the replacement or refund (if any) via email soon as practicable.
  5. TRANS FASHION INDONESIA may at its discretion refuse to process a replacement/exchange order, and may, at its discretion, offer a refund as a substitute remedy.
  6. If there is no damage to the Product returned, TRANS FASHION INDONESIA have it up to  decide not to replace the Product or refund and/or may ask you to pay all reasonable shipping and service fees in accordance with our current standard fees and other fees to the debut card. you or any other payment information you provide when you place an Order, and to the maximum extent permitted by law, we are not liable to you for any loss, liability, cost of damages or other costs.

VOUCHERS

  1. You may use promotional vouchers and e-gift cards while making payment for Products on the Platform. Specific details for promotional vouchers and e-gift cards are listed below.
  2. Promotional vouchers must be entered at the check-out page online only. Physical presentation of vouchers to TRANS FASHION INDONESIA personnel/Delivery staff will not be accepted.
  3. In the event of fraud, an attempt at deception or in the event of the suspicion of other illegal activities in connection with an e-gift card purchase or redemption of that voucher on the Platform, we are entitled to close your Account and/or require a different means of payment.
  4. We assume no liability for the loss, theft or illegibility of gift or promotional vouchers.
  5. In rare cases, TRANS FASHION INDONESIA may at its sole discretion discontinue or cancel any voucher previously issued and will not be responsible for any losses arising therefrom.
  6. Conditions for the redemption of promotional vouchers:
    From time to time we may distribute promotional vouchers that may be used only on the Platform, which we will send to you either by email or post:
    (a) Promotional vouchers are valid for the specified period stated on the voucher, can only be redeemed once and may not be used in conjunction with other promotional vouchers and discounted items. We may exclude individual brands from voucher promotions in accordance with our sales strategies. The current list of exclusions can be found here.
    (b) You may redeem only ONE voucher per promotional campaign. TRANS FASHION INDONESIA reserves the right to cancel any subsequent orders made by you using a voucher of the same promotional campaign.
    (c) If you place an Order for a Product less than the value of the promotional voucher, no refund or residual credit will be returned to you.
    (d) The credit of a promotional voucher does not accrue interest, nor does it have a cash value.
    (e) If the credit of a promotional voucher is insufficient for the Order you wish to place, you may make up the difference using one of our accepted payment methods.
    (f) For cash vouchers stipulated for a specified sum, if you choose to return the product, you will not be refunded the value of the cash voucher. However, if you paid partly with your own funds, this portion will be refunded.

  1. Conditions for the redemption of e-gift cards:
    You may purchase e-gift cards for use on the Platform by you or other Customers. The conditions in clause redemption of promotional vouchers shall apply to e-gift cards. These e-gift cards will be sent by email.
    (a) E-gift cards cannot be used to buy further e-gift cards. E-gift cards may be purchased using any of our accepted payment methods.
    (b) The credit of an e-gift card does not accrue interest, nor does it have a cash value.
    (c) An order for an e-gift card can be cancelled by contacting us via chat here. or sending us an email at info@transfashionindonesia.com. A voucher is considered to have been redeemed if it is used as payment in placing an Order.
    (d) If the credit of an e-gift card is insufficient for the Order you wish to make, you may make up the difference using one of our accepted payment methods.

DISCLAIMER OF LIABILITY

  1. All Product descriptions, information and materials posted on this Platform are provided ‘as is’ and without warranties express, implied or otherwise, and however arising.

INDEMNITY

You agree to indemnify, defend, hold harmless TRANS FASHION INDONESIA, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including but not limited to, legal fees) arising from your use of this Platform or your breach of these Terms Of Use.

GUARANTEE AND COMPLAINTS MANAGEMENT

  1. TRANS FASHION INDONESIA shall perform its obligations under these Terms Of Use with reasonable skills and care.
  2. TRANS FASHION INDONESIA will place great value on our Customer satisfaction. You may contact us at any time using the contact details here. We will attempt to address your concerns as soon as possible and will contact you on receipt of any relevant enquiry or complaint. In guarantee cases, the manufacturer or supplier must generally be involved, and as such it may take longer to resolve such an enquiry or complaint.
  3. In the event of a complaint, it will help us if you can describe the object of your complaint as accurately as possible and, where applicable, send us copies of the Order or at least the Order number that was assigned to you in the Order Acknowledgment. In rare cases, your emails may be caught up in our spam filters or not reach us, or correspondence that we send to you may otherwise not have reached you. If you did not receive any response from us within five (5) Business Days, please make further enquiries.

PERSONAL DATA PROTECTION

CIRCUMSTANCES BEYOND OUR CONTROL (FORCE MAJEURE)

We shall not be liable to you for any breach, hindrance or delay in the performance of a Order attributable to any cause beyond our reasonable control, including without limitation:

  1. Strikes, lock-outs or other industrial action.
  2. Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
  3. Fire, explosion, storm, flood, earthquake, subsidence, pandemic, epidemic or other natural disaster.
  4. Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
  5. Impossibility of the use of public or private telecommunications networks.
  6. The acts, decrees, legislation, regulations or restrictions of any government, shipping, postal or other relevant transport strike, failure or accidents.
  7. In the circumstance that the Force Majeure event lasts for more than one week, either you or we may terminate the Contract forthwith by written notice and without any liability other than a refund of a Product already paid for by you and not delivered.
  8. If we have contracted to provide identical or similar Products to more than one Customer and are prevented from fully meeting our obligations to you by reason of a Force Majeure event, we may decide at our absolute discretion which Contracts we will perform and to what extent.
  9. We reserve absolute discretion on the solution we adopt in fully meeting our obligations under the Contract despite the Force Majeure Event.

NOTICES

Any notice under an Order shall be given in writing through either letter or email to the relevant party at the address or email address last known to the other.

  1. Notices given by post shall be deemed to have been served with two (2) Business Days of being posted to the recipient’s address within Indonesia.
  2. Any notice given by email shall be deemed to have been served within two (2) Business Days after the email being sent.
  3. In proving such service it shall be sufficient to prove that the letter or email was properly addressed and, as the case may be, posted as a prepaid or recorded delivery letter or dispatched or a delivery report received.

INTELLECTUAL PROPERTY RIGHTS

  1. All content included in or made available through our Platform, such as text, graphics, logos, button icons, images, audio clips, digital downloads, campaign titles and data compilations is the property of TRANS FASHION INDONESIA or its content suppliers and is protected by copyright laws and treaties around the world. All such rights are reserved by TRANS FASHION INDONESIA and its licensors. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Platform nor may you use any such content in connection with any business or commercial enterprise.
  2. In addition, graphics, logos, page headers, button icons, scripts, and service names included in or made available through the Platform are trademarks of TRANS FASHION INDONESIA in Indonesia and other countries. TRANS FASHION INDONESIA’s trademarks may not be used in connection with any product or service that is not provided by TRANS FASHION INDONESIA, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits TRANS FASHION INDONESIA. All other trademarks not owned by TRANS FASHION INDONESIA that appear on the Platform are the property of their respective owners.
  3. Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.
  4. You must not use any part of the content on our site for commercial purposes without obtaining a license to do so from us or our licensors. In the event TRANS FASHION INDONESIA becomes aware of any infringement of its intellectual property rights, it shall not refrain from taking any relevant legal action.
  5. If you print, copy or download any part of our Platform in breach of these Terms Of Use, your right to use our Platform will cease immediately and you must, at our option, return or destroy any copies of the materials you have made. You shall not modify, translate, reverse engineer, decompile, disassemble or create derivative works based on any software or accompanying documentation supplied by TRANS FASHION INDONESIA or its licensors.

WAIVER

No failure or delay by TRANS FASHION INDONESIA or you in exercising any right under these Terms Of Use shall operate as a waiver of such right or extend to or affect any other or subsequent event or impair any rights or remedies in respect of it or in any way modify or diminish our or your rights under these Terms Of Use.

SEVERABILITY

If any clause in these Terms Of Use shall become or shall be declared by any court of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall in no way affect any other clause or part of any clause, all of which shall remain in full force and effect, so long as these Terms Of Use shall be capable of continuing in effect without the unenforceable term.

ASSIGNMENT

You shall not assign, transfer, novate, charge, sub-Contract, create any trust over or deal in any other manner with these Terms Of Use or all or any of your rights or obligations under these Terms Of Use.

RELATIONSHIP

Nothing in these Terms Of Use shall create or be deemed to create a partnership, an agency or a relationship of employer and employee between you and TRANS FASHION INDONESIA.

THIRD PARTY RIGHTS

No person who is not a party to these Terms Of Use shall acquire any rights under it or be entitled to benefit from any of its terms even if that person has relied on any such term or has indicated to any party to these Terms Of Use or that Contract its assent to any such term.

GOVERNING LAW

These Terms Of Use and a Contract (and all non-Contractual obligations arising out of or connected to them) shall be governed and construed in accordance with the laws of Indonesia. Both you and TRANS FASHION INDONESIA hereby agree to submit to the non-exclusive jurisdiction of the courts of Indonesia. Every dealings, correspondence and agreements between you and TRANS FASHION INDONESIA shall be made or conducted in the English language.

VARIATION

TRANS FASHION INDONESIA reserve the right to amend these Terms Of Use and policies at any time at sole discretion without prior notice. All amendments to these Terms Of Use, including policies will be posted on our Platform and be effective immediately. Your continued use of the Platform constitutes acceptance of the amended Terms Of Use.
